TALKGUEST is responsible for the processing of your personal data within the meaning of the General Data Protection Regulation (hereinafter referred to as GDPR).
Personal data is any information, of any nature and regardless of its support, including sound and image, relating to an identified or identifiable natural person.
A person who can be identified directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, electronic identifiers or one or more specific elements of identity, is considered identifiable. physical, physiological, genetic, mental, economic, cultural or social nature of that natural person.
As part of its activity, TALKGUEST will collect and process the personal data necessary to provide services, namely name, address, telephone number, email address, address, Internet Protocol (IP) address, number tax and citizen card number and voice registration.
Your personal data may be collected and processed by TALKGUEST for the following purposes:
- To comply with legal obligations to which TALKGUEST is subject, namely billing for contracted services.
- For the purposes of executing the Service Provision Contract (hereinafter referred to as CONTRACT) entered into with TALKGUEST and respective pre-contractual measures, namely customer support, management of the contractual relationship, the provision of contracted goods and services and the adequacy of services to your needs and interests.
- For contact purposes, within the scope of TALKGUEST's marketing strategies, with information and commercial communications during and after the end of the CONTRACT.
- For the purposes of quality control of customer support services provided by TALKGUEST, namely through call recording.
Failure to provide personal data for the purposes set out in subparagraphs a) and b) implies non-compliance, on the part of TALKGUEST, with contractual and legal obligations imposed on it, a situation that the Parties consider to constitute a basis for non-conclusion and/ or termination of the CONTRACT by TALKGUEST, without the right to any compensation or compensation. TALKGUEST will inform you of the mandatory nature of the data.
If you do not want your call to be recorded, you should contact TALKGUEST through alternative support channels.
The processing of your personal data will be carried out based on the execution of the CONTRACT signed with TALKGUEST and in strict compliance with legal obligations imposed on TALKGUEST, particularly in matters of tax legislation (article 6.º no. 1 paragraph b) and c) of the GDPR).
Additionally, the lawfulness of processing personal data collected for the purpose set out in subparagraph c) of the previous point is based on the consent you have given to TALKGUEST for the respective processing (article 6.º no. 1 subparagraph a) of the GDPR) .
For the purpose set out in subparagraph d) of the previous point, TALKGUEST will process personal data based on the legitimate interest it pursues (cf. subparagraph f) of paragraph 1 of article 6 of the GDPR), as well as the consent given (Article 6(1)(a) GDPR).
Without prejudice to the following paragraph and legal provisions, regulations or judicial determination to the contrary, the personal data collected will be kept only for the minimum period necessary for the purposes that motivated their collection or subsequent processing.
Telephone calls recorded by TALKGUEST will be kept for a period of 90 (ninety) days after collection.
Eventually, TALKGUEST may have to share some of your personal data with other recipients, which include:
a) Organizations and/or companies affiliated with TALKGUEST, as long as they respect an equivalent policy regarding the protection of personal data.
b) Public Entities to which TALKGUEST is legally obliged to provide information, namely the DGCI – General Directorate of Taxes.
c) Subcontractors who provide certain services related to your personal data under the cover of a subcontract and for the sole purpose of providing technical assistance to TALKGUEST, which include, but are not limited to, website hosting providers, mail marketing services and billing software supply companies.
d) The competent authorities to which TALKGUEST is legally obliged to disclose information in the course of legal proceedings or to detect technical and/or security problems, such as Judicial Entities or competent Control Authorities.
Your personal data collected by TALKGUEST will, as a rule, not be transferred to any entity established outside the territory of the European Union.
Exceptionally and under certain conditions, TALKGUEST may transfer your personal data to countries outside the territory of the European Union, in accordance with applicable legislation, for the purposes of data hosting or storage, technical subcontracting of processing, back-up and recovery of hosted data, service development.
TALKGUEST assures you that it will not transfer your personal data to countries that do not guarantee an adequate level of protection, in accordance with the provisions of the GDPR.
In accordance with the provisions of the GDPR, you may request, at any time:
one) access to your personal data: you have the right to obtain confirmation as to whether or not personal data concerning you are being processed and, if this is the case, the right to access your personal data and the information provided for in the GDPR.
b) the rectification of your personal data: You have the right to obtain, without undue delay, from TALKGUEST the rectification of inaccurate personal data concerning you.
c) the deletion of your personal data: You have the right to obtain from TALKGUEST the erasure of your personal data, without undue delay, and TALKGUEST has the obligation to erase personal data, without undue delay, when one of the following reasons applies, in particular: 1) personal data are no longer necessary for the purpose for which they were collected or processed; 2) the data subject withdraws the consent on which the data processing is based (when it is based on consent) and if there is no other legal basis for said processing; 3) the data subject opposes the processing and there are no prevailing legitimate interests that justify the processing;
and) to limit the treatment carried out: you have the right to obtain from the person responsible for TALKGUEST the limitation of processing, if one of the following situations applies: one) contest the accuracy of personal data, for a period that allows the controller to verify its accuracy; b) the processing is unlawful and the data subject opposes the erasure of personal data and requests, in return, the limitation of its use; c) TALKGUEST no longer needs personal data for processing purposes, but such data is required by the holder for the purposes of declaring, exercising or defending a right in legal proceedings; and) if you have objected to the processing, until it is verified that TALKGUEST's legitimate reasons prevail over those of the data subject.
and) the right to object to processing: When processing is carried out for the purposes of the legitimate interests pursued by TALKGUEST, the data subject has the right to object at any time, for reasons related to his or her particular situation, to the processing of personal data concerning him or her. TALKGUEST ceases the processing of personal data, unless it presents compelling and legitimate reasons for such processing that prevail over the interests, rights and freedoms of the data subject, or for the purposes of declaring, exercising or defending a right in legal proceedings .
and) the right to data portability: You have, under the terms and conditions defined by law, the right to receive the personal data that concerns you and that you have provided to TALKGUEST, in a structured, commonly used and machine-readable format, and the right to transmit this data to another responsible for the processing without the person responsible to whom the personal data were provided being able to prevent it, if: one) The processing is based on consent or a contract; and b) The processing is carried out by automated means
If the requests submitted are manifestly unfounded or excessive, particularly due to their repetitive nature, TALKGUEST may (i) demand payment of a reasonable fee taking into account the administrative costs of providing the information or communications, or taking the requested measures, or (ii) refuse to comply with the request.
In relation to personal data whose processing by TALKGUEST is legitimized by the consent granted by you, you are granted the right to withdraw consent, without the exercise of such right being able to compromise the lawfulness of the processing carried out based on the consent previously given, nor the subsequent processing of the same data, based on another legal basis, such as compliance with a contractual or legal obligation to which TALKGUEST is subject.
You also have the right to lodge a complaint with the National Data Protection Commission.
Within the scope of the consent provided by you, TALKGUEST may promote, in particular, actions to publicize new products or services, via telephone, email, mail, SMS, MMS, or any other electronic communications service.
If you do not want your personal data to be processed, you can object, at any time, to the use of your personal data for marketing purposes, sending informative communications or inclusion in lists or informative services.
